Welcome to Video Game Legacy.

These Terms & Conditions (“Terms”) govern your use of the Video Game Legacy website, its features, community areas, contributions, content, services and the Legacy Store.

By using Video Game Legacy, you agree to these Terms. If you do not agree with them, please do not use the website.

Video Game Legacy is an independent UK gaming website and store operated by a UK sole trader trading as Video Game Legacy.

Legal name: Michael Vollans

Trading name: Video Game Legacy

The business operates online and does not offer in-person shopping or collection.

1. About Video Game Legacy

Video Game Legacy is a gaming website focused on video-game history, preservation, collections, databases, checklists, challenges, features, guides, reviews, community contributions and related gaming content.

The website may change, expand or remove features over time.

Nothing on Video Game Legacy should be interpreted as creating an official relationship with a game developer, publisher, console manufacturer or other rights holder unless we expressly state otherwise.

2. Using the Website

You may use Video Game Legacy for lawful personal purposes.

You must not:

  • Use the website for unlawful, fraudulent or abusive purposes.

  • Attempt to damage, disrupt or interfere with the website or its security.

  • Attempt to gain unauthorised access to systems, accounts or data.

  • Introduce malicious code, malware or other harmful material.

  • Scrape, harvest or systematically extract substantial amounts of Video Game Legacy content without permission.

  • Impersonate Video Game Legacy, its contributors or another person.

  • Use the website in a way that infringes another person's rights.

We may restrict access to the website or particular features where reasonably necessary to protect Video Game Legacy, its users or its services.

3. Video Game Legacy Content

Unless otherwise stated, original material created by Video Game Legacy — including original writing, research, databases, checklist designs, graphics, branding, layouts and other original material — belongs to Video Game Legacy or is used with appropriate permission.

You may view and use this material for your own personal, non-commercial purposes.

You must not reproduce, republish, sell, commercially exploit or falsely present Video Game Legacy's original work as your own without permission, except where the law expressly permits you to do so.

If you would like permission to use Video Game Legacy material, contact:

contact@videogamelegacy.com

4. Games, Characters and Third-Party Intellectual Property

Video Game Legacy discusses and documents games, characters, consoles, companies and other material belonging to third parties.

Game names, characters, logos, trademarks, screenshots, artwork and other third-party intellectual property remain the property of their respective owners.

Their appearance on Video Game Legacy does not mean that the relevant rights holder sponsors, endorses or is affiliated with Video Game Legacy unless expressly stated.

Video Game Legacy does not claim ownership of third-party intellectual property merely because it appears within our editorial, historical, preservation or community content.

5. Information and Research

Video Game Legacy aims to provide accurate information and takes its research and preservation work seriously.

However, video-game history and release information can be incomplete, disputed or subsequently corrected.

We therefore cannot guarantee that every release date, regional record, technical detail, collection entry, database record or other piece of information will always be complete or error-free.

Where we discover an error, we may correct or update our content.

If you believe something is incorrect, you are welcome to contact us.

6. Checklists and Databases

Video Game Legacy checklists and databases are provided as informational and collecting resources.

They may be updated when new releases, variants, research or corrections become available.

Completion percentages, item totals and collection information may therefore change over time.

A Video Game Legacy checklist is not a guarantee of authenticity, rarity, condition, value or market price of any item.

Collectors remain responsible for checking items before purchasing, selling or trading them.

7. Challenges and Community Projects

Video Game Legacy operates gaming challenges, collection projects and other community features.

Rules may vary between individual challenges and will normally be stated on the relevant challenge page.

Challenge results, rankings, leaderboards and completion records are maintained for entertainment and community purposes.

They should not be interpreted as official competitive rankings or records recognised by a game's developer, publisher or governing body unless expressly stated.

We may correct challenge records where an error is discovered.

8. Contributions

Video Game Legacy may allow visitors to contribute screenshots, photographs, videos, written material, collection information, corrections, gaming records or other material.

You retain ownership of original material that you submit.

By deliberately submitting material to Video Game Legacy for publication, you give Video Game Legacy a non-exclusive, royalty-free permission to store, reproduce, resize, crop, format and publish that material as reasonably necessary to display, archive and promote the contribution through Video Game Legacy.

This permission does not transfer ownership of your original work to Video Game Legacy.

Where appropriate, we will attribute published contributions using the name, username or gamer tag supplied for that purpose.

9. Responsibility for Contributions

You should only submit material that you have the right to provide.

By submitting content, you confirm that, to the best of your knowledge:

  • You created it or otherwise have permission to submit it.

  • Its publication does not knowingly infringe another person's rights.

  • It does not contain unlawful material.

  • It does not intentionally contain malicious or misleading material.

  • You have appropriate permission before providing identifiable personal information about another person.

Please do not submit confidential information through community contribution forms.

10. Editing and Moderating Contributions

Submission does not guarantee publication.

Video Game Legacy may:

  • Decline a contribution.

  • Correct spelling, formatting or obvious factual errors.

  • Resize or crop submitted media.

  • Remove material that breaches these Terms.

  • Remove spam, abusive material or irrelevant submissions.

  • Withdraw previously published material where reasonably necessary.

We will not intentionally alter the meaning of a genuine contribution simply to misrepresent the contributor.

11. Requests to Remove Contributions

If you previously contributed material and would like to discuss its removal, contact:

contact@videogamelegacy.com

We will consider reasonable requests.

Removal may not always be possible where material has already been incorporated into historical records, backups, publications or other material that must reasonably be retained, but we will assess requests individually.

Your data-protection rights are explained separately in our Privacy Policy.

12. Comments and Community Conduct

Video Game Legacy may provide commenting facilities through services such as Disqus.

You are responsible for what you post.

Comments or community content must not contain:

  • Unlawful content.

  • Threats or harassment.

  • Discriminatory abuse or hate speech.

  • Deliberate impersonation.

  • Spam or malicious links.

  • Private personal information published without permission.

  • Material that infringes intellectual-property rights.

  • Deliberately fraudulent or deceptive content.

Video Game Legacy may moderate, hide or remove material where reasonably necessary.

Third-party commenting platforms may also enforce their own terms and moderation policies.

13. Reviews and Opinions

Reviews, commentary, rankings and editorial opinions published by Video Game Legacy represent the views of the relevant author unless stated otherwise.

Opinions may differ between contributors.

Where a review copy, product sample, sponsorship, affiliate relationship or other material connection exists, Video Game Legacy will aim to disclose that relationship where appropriate.

Editorial opinion is not for sale.

14. External Links

Video Game Legacy may link to third-party websites, retailers, social networks, videos, databases and other external resources.

External websites are operated independently.

We are not responsible for their content, security, availability, privacy practices or subsequent changes.

A link does not automatically mean that Video Game Legacy endorses everything available on the linked website.

15. Embedded Content

Video Game Legacy may embed material from services such as YouTube and other third-party platforms.

Those services may operate under their own terms, privacy policies and technical systems.

Your interaction with an embedded third-party service may therefore also be governed by that provider's terms.

16. Affiliate Links and Commercial Relationships

Video Game Legacy may in future use affiliate links or enter commercial relationships with third parties.

Where reasonably required, these relationships will be identified.

The existence of an affiliate link does not change the price charged by Video Game Legacy unless expressly stated.

Editorial coverage and opinions will not automatically become positive because of an affiliate or commercial relationship.

17. The Legacy Store — Overview

The Legacy Store may sell physical gaming-related products when individual product listings are made available for purchase.

The product listing, applicable delivery information, these Terms and the Returns & Refunds Policy apply to purchases made through the Legacy Store.

The detailed store provisions appear in Sections 26–41 below.

Information specific to an individual product or order forms part of the relevant transaction, subject to applicable consumer law.

Nothing in these Terms excludes or restricts statutory consumer rights that cannot lawfully be excluded.

Future store features mentioned on the website are not currently available unless expressly launched.

18. Prices and Collector Information

Any prices, valuations, collection values, historical prices or similar information shown outside an active sales listing are informational only unless expressly stated otherwise.

The market value of games and collectables can change.

Video Game Legacy does not guarantee that an item can be bought or sold for a particular value simply because a price or valuation has appeared on the website.

19. Website Availability

We aim to keep Video Game Legacy available and functioning correctly but cannot guarantee uninterrupted access.

The website may occasionally be unavailable because of:

  • Maintenance.

  • Technical problems.

  • Hosting or third-party service failures.

  • Security issues.

  • Circumstances outside our reasonable control.

We may modify, suspend or discontinue parts of the website where reasonably necessary.

20. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Subject to that limitation, Video Game Legacy is not responsible for losses caused solely by:

  • Reliance on information that was clearly provided for general informational purposes.

  • Temporary website unavailability outside our reasonable control.

  • Actions taken on independent third-party websites.

  • User-submitted material that Video Game Legacy could not reasonably have known was unlawful or infringing before being notified.

These Terms do not affect rights or remedies that the law gives you and which cannot legally be excluded.

21. Privacy and Cookies

Use of personal information is governed by the Video Game Legacy Privacy Policy.

The website may also use cookies and similar technologies as explained through our cookie controls, Cookie Policy and Privacy Policy.

22. Children and Younger Users

Video Game Legacy is a general gaming website and gaming naturally attracts users of different ages.

Younger users should involve a parent or guardian before submitting personal information, making purchases or participating in activities where parental permission may be appropriate.

We may restrict a submission or transaction where reasonably necessary because of age or safeguarding concerns.

23. Changes to These Terms

Video Game Legacy may update these Terms where the website, its services, applicable law or our operating practices change.

The latest version will be published on this page.

The date at the top of the page will show when these Terms were last updated.

Changes will not retrospectively remove contractual or statutory rights relating to orders already placed.

24. Applicable Law

These Terms are subject to applicable UK law.

Nothing in these Terms deprives a consumer of any mandatory legal rights or protections that apply to them.

25. Contact

Questions about these Terms can be sent to:

Video Game Legacy

Email: contact@videogamelegacy.com

Business address:

Michael Vollans 7 High Street Staincross Barnsley South Yorkshire S75 5AZ United Kingdom

26. Legacy Store — Sales Terms

Video Game Legacy may sell video games, collectables, accessories, merchandise and other gaming-related products through the Legacy Store.

At launch, the store sells physical products to customers in the United Kingdom.

Where a product is offered for sale, the product listing, applicable delivery information and these Terms form part of the information supplied for that purchase.

Nothing in these Terms affects any statutory consumer rights that cannot legally be excluded or restricted.

27. Product Descriptions and Condition

We aim to describe products as accurately as reasonably possible.

Where applicable, products may be identified by condition, including descriptions such as New in Box, Loose, used, boxed or other relevant condition information.

Photographs, descriptions and condition notes should be reviewed before purchasing.

Minor differences in colour or appearance may occur because of photography, lighting, display settings or manufacturing variation.

Used and collectable items may show signs of age, use or storage where stated.

Known condition issues that materially affect a product will be disclosed where reasonably identifiable.

Nothing in these Terms removes a customer's statutory rights where goods are faulty, not as described or not of satisfactory quality.

28. Prices

Prices shown on the Legacy Store are the prices payable for the relevant product, subject to the final order total displayed during checkout.

Any applicable delivery charge will be shown before the customer completes the order.

Where taxes are required to be included in the displayed price, they will be handled in accordance with applicable law.

Customers will be able to review the total payable before placing an order.

If an obvious pricing or listing error is discovered, we will contact the customer and explain the situation.

Where an order cannot lawfully or reasonably be fulfilled, we will resolve the matter in accordance with applicable consumer and contract law, including any refund due.

29. Orders

Customers place orders by selecting available products, adding them to the cart, reviewing their order, entering the necessary contact and delivery information, selecting an available payment method and completing checkout.

Customers should check their order details and correct any errors before submitting payment.

Submitting an order is a request to purchase the selected products.

An automated order acknowledgement may be sent after checkout. We will process orders subject to payment authorisation, product availability and the information supplied at checkout.

We may be unable to fulfil an order where:

  • An item is no longer available.

  • An obvious pricing or listing error has occurred.

  • Payment cannot be authorised.

  • Delivery cannot reasonably be completed.

  • We reasonably suspect fraud or misuse.

Where an order cannot be fulfilled, we will contact the customer and arrange the appropriate resolution, including a refund of any payment taken for goods that cannot be supplied.

Nothing in this section removes rights arising from an accepted contract or applicable consumer law.

30. Payment

Available payment methods will be displayed during checkout.

Customers must provide accurate billing and payment information.

Payments are processed through the payment services available on the website.

Video Game Legacy does not intentionally store full payment-card details where payment processing is handled by an independent payment provider.

The customer's selected payment provider may apply its own terms to the payment service.

The use of a particular payment method does not remove any statutory consumer rights relating to the purchase.

31. Delivery

Delivery Destinations

At launch, the Legacy Store ships to United Kingdom addresses only.

International shipping is not currently available.

No in-person collection or local delivery service is offered.

UK Delivery Charges

The initial Amiibo card catalogue uses Royal Mail Tracked 48.

The customer shipping charge is £3.50 per order, with no additional per-card shipping charge.

Cards are packed using protective sleeves and cardboard-backed envelopes.

Where an unusually large order requires a different postal format or weight bracket, Video Game Legacy will absorb the additional postage cost rather than automatically increasing the agreed £3.50 charge for that order.

For future product categories with different shipping requirements, the applicable delivery charge will be displayed before the customer completes the purchase.

Dispatch and Delivery

We aim to dispatch orders as promptly as reasonably practicable after payment has been accepted.

Orders will be prepared and dispatched in sufficient time to meet the applicable delivery obligation.

Royal Mail Tracked 48 normally aims to deliver within two to three working days after dispatch. This is a delivery aim rather than a guaranteed delivery deadline.

Delivery may take longer because of remote locations, bank holidays, postal disruption or other circumstances affecting the delivery service.

Unless a different delivery period has been expressly agreed with the customer, we will deliver goods without undue delay and within 30 days of the contract being entered into.

Where a specific delivery period is agreed, that period will apply.

Tracking and Signatures

Where tracking is provided, customers may receive tracking information after dispatch.

Royal Mail Tracked 48 provides delivery tracking.

A signature on delivery is not automatically included unless the relevant shipping option expressly states that signature confirmation is provided.

Lost, Damaged or Delayed Deliveries

If a delivery is lost, damaged or significantly delayed, customers should contact:

contact@videogamelegacy.com

Video Game Legacy remains responsible for the goods until they come into the physical possession of the customer or a person identified by the customer to receive them, subject to the applicable rules where a customer independently commissions a carrier not offered by Video Game Legacy.

Customers are not required to pursue Royal Mail instead of Video Game Legacy for a problem with an order delivered using our chosen postal service.

Where delivery cannot be completed within the applicable period, customers retain their statutory rights, including rights relating to late delivery, cancellation and refunds.

32. Cancellation of Online Orders

Where the statutory cancellation right applies, customers purchasing physical goods online may cancel their order without giving a reason.

The usual cancellation period ends 14 days after the day the customer receives the goods.

Where an order is delivered in separate instalments, the period generally runs from receipt of the final item.

Customers may also request cancellation before receiving their order.

To exercise the cancellation right, customers must notify Video Game Legacy by a clear statement before the applicable cancellation period expires.

Cancellation requests can be sent to:

contact@videogamelegacy.com

Customers may use the model cancellation form provided in our Returns & Refunds Policy, but using that form is not compulsory.

After notifying us of cancellation, the customer generally has a further 14 days to return the goods.

Certain statutory exceptions to the cancellation right may apply to particular types of products or transactions. Any relevant exception will be explained where applicable.

Ordinary collectable cards are not automatically excluded from the statutory cancellation right merely because they are collectables, used, loose or removed from packaging for reasonable inspection.

The full cancellation instructions are provided in our Returns & Refunds Policy.

33. Returns Following a Change of Mind

Where a customer exercises a statutory cancellation right, goods should be returned in accordance with the return instructions supplied by Video Game Legacy.

For a change-of-mind return, customers are responsible for the direct cost of return postage.

We recommend using tracked postage and suitable protective packaging when returning collectables.

Customers may inspect goods in the same way they reasonably could in a physical shop.

Where goods have been handled beyond what is reasonably necessary to establish their nature, characteristics and functioning, the law may permit an appropriate deduction from the refund for resulting loss in value.

This does not permit an automatic deduction merely because the customer has opened packaging to inspect the goods.

The rules for faulty, damaged, incorrectly supplied or misdescribed goods are separate from the ordinary change-of-mind cancellation rules.

34. Refunds

Where a valid statutory cancellation applies, we will provide the refund required by law.

For a cancellation involving returned physical goods, refunds will be made without undue delay and no later than 14 days after we receive the returned goods or the customer provides evidence of having sent them back, whichever is earlier.

Where no goods have been supplied, the applicable refund period runs from the cancellation notification.

Refunds will normally be made using the original payment method unless the customer expressly agrees otherwise.

No refund administration fee will be charged.

Where an entire order is cancelled under the statutory cancellation right, the original standard outbound delivery charge will also normally be refunded.

If a customer selected a more expensive delivery service than the least expensive standard delivery option offered, we are not required to refund the additional cost of that more expensive service.

Partial cancellations and returns will be handled in accordance with the applicable consumer-law requirements.

Nothing in these Terms removes the customer's separate rights to remedies for faulty or misdescribed goods.

35. Faulty or Misdescribed Goods

Customers have statutory rights when goods are faulty, not as described, not of satisfactory quality or not fit for purpose.

These rights apply independently of any change-of-mind returns policy.

Depending on the circumstances, customers may be entitled to a refund, repair, replacement or another remedy provided by law.

Consumers generally have a short-term right to reject faulty goods within 30 days, subject to the applicable statutory conditions. Other rights may continue after that period.

Where required by law, Video Game Legacy will cover reasonable return costs for faulty or incorrectly supplied goods.

Customers should contact:

contact@videogamelegacy.com

Nothing in these Terms limits or removes those rights.

36. Collectables and Authenticity

Video Game Legacy will aim to identify products accurately and disclose relevant known condition information.

Collectors should review photographs and descriptions carefully before purchasing.

Where authenticity is specifically stated as part of a product description, that description forms part of the information supplied with the item.

Used products may have disclosed signs of age, storage or previous ownership.

Nothing in this section limits statutory rights where goods are not as described, are faulty or do not meet applicable consumer-law requirements.

37. Preorders

If Video Game Legacy offers preorders in future, the relevant listing will explain the expected release or dispatch period and any special preorder conditions.

Release dates may change where manufacturers, publishers or suppliers alter their schedules.

Customers will retain any cancellation or consumer rights that apply under law.

Preorders are not part of the initial store arrangements unless expressly made available.

38. Digital Products

If Video Game Legacy sells downloadable or streamed digital content in future, additional rules will apply.

Where required, customers will be asked to expressly agree to immediate supply and acknowledge when beginning the download or stream causes them to lose the standard cancellation right.

Any required consent and acknowledgement will be obtained before the relevant digital content is supplied.

Digital products are not part of the initial physical-product store arrangements unless expressly made available.

39. Legacy Buy Price and Future Buyback Services

Video Game Legacy may in future display a Legacy Buy Price, representing an amount that Video Game Legacy may be willing to pay for a particular item.

Displaying a Legacy Buy Price does not by itself create a binding obligation to purchase an item.

Any future buyback service may be subject to inspection, condition requirements, authenticity checks and separate terms before an offer becomes final.

The Legacy Buy Price and buyback service are future features and do not form part of the initial store unless expressly launched.

40. Future Community Marketplace

Video Game Legacy may in future allow third-party sellers to offer products through the website.

If this feature launches, separate marketplace terms will be introduced explaining the relationship between Video Game Legacy, buyers and third-party sellers, including fees, seller responsibilities, disputes, payments and consumer rights.

Until those marketplace terms are introduced, no general wording on this website should be interpreted as creating a third-party selling service.

41. Store Policies and Order Confirmation

Our Terms & Conditions, Privacy Policy and Returns & Refunds Policy will be made available to customers before they complete a purchase.

Customers must be able to access and retain the contractual information applicable to their order.

Following a purchase, Video Game Legacy will provide the required order and contractual information in a durable form, such as email, within the applicable legal timeframe and no later than delivery of the goods.

This information will include the details required for the transaction and the applicable cancellation information.

Customers should retain their order confirmation and relevant correspondence for future reference.
